Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Webshop: Passion & Pleasure, operating as a sole proprietorship.
- Website: The online store accessible via our domains and subdomains.
- Consumer: A natural person who is not acting in the exercise of a profession or business and who enters into a distance agreement with the Webshop.
- Product: All goods offered via the webshop, including but not limited to adult toys, lingerie, accessories, and related products.
- Order: Every distance agreement concluded between the Consumer and the Webshop.
- Right of Withdrawal: The statutory option for Consumers to cancel the agreement within the cooling-off period.
- Cooling-off period: A period of 14 days after receipt of the Product, unless excluded.
- Return: The return shipment of products in accordance with these terms and conditions.
- Discretion: Delivery, packaging methods, and invoicing executed without traceable product information.
Article 2 – Applicability
- These general terms and conditions apply to every offer made by the Webshop, to all orders, and to all distance agreements concluded between Passion & Pleasure and the Consumer.
- It is a prerequisite that the Consumer has the opportunity to review these terms and conditions before the agreement is concluded.
- If specific product conditions apply (for example, regarding hygiene), these specific terms shall take precedence over the general provisions where applicable.
- Deviations from these terms and conditions are only valid if explicitly agreed upon in writing.
Article 3 – Offer & Representation
- The offer contains a complete and accurate description of the products offered, including price indications and VAT.
- Obvious mistakes or typographical errors do not bind the Webshop.
- Images are for illustrative purposes only; variations in color and shape are possible.
- All offers are non-binding until the order has been confirmed.
Article 4 – Conclusion of the Agreement
- The agreement is concluded at the moment the Consumer completes the payment, unless otherwise agreed.
- After placing an order, the Consumer will receive a confirmation email.
- If the Webshop refuses an order (for example, due to stock levels or safety reasons), the Consumer will be notified in a timely manner, and any paid amount will be refunded if applicable.
Article 5 – Prices & Payment
- All prices displayed on the website are in Euros and include VAT, unless stated otherwise.
- During the validity period of the offer, prices will not be increased, except as a result of statutory changes or manifest errors.
- The Consumer can pay using the payment methods offered during the ordering process, including electronic payments.
- The agreement is considered finalized as soon as the payment has been successfully completed, unless otherwise agreed.
Article 6 – Delivery, Shipping, and Discretion
- Orders will be shipped to the address specified by the Consumer.
- The Webshop delivers within the Netherlands and Europe, unless indicated otherwise.
- Products are packed and shipped discreetly, without any traceable product descriptions on the outside of the packaging.
- The Webshop uses a discreet payment and billing descriptor in accordance with the nature of the product.
- The delivery time is typically 1–3 business days within the Netherlands and 2–5 business days to Belgium, unless stated otherwise.
- Exceeding the delivery time does not entitle the Consumer to compensation, unless the delay is such that the Consumer cannot reasonably be expected to maintain the agreement.
- The risk of damage or loss of products transfers to the Consumer at the moment of delivery.
Article 7 – Right of Withdrawal (Cooling-off Period)
- The Consumer has the right to dissolve the agreement without giving reasons within 14 days of receiving the product.
- If the Consumer wishes to exercise the right of withdrawal, they must notify the Webshop within the cooling-off period via email or the return form.
- Following this notification, the Consumer has a maximum of 14 days to return the product.
- The Consumer is responsible for the direct costs of returning the goods, unless confirmed otherwise in writing.
- Upon correct receipt of the return, the Webshop will refund the purchase amount within 14 days of receiving the returned product.
Article 8 – Exceptions: Hygiene and Seals
Due to hygienic and health protection reasons, the following products are strictly excluded from the right of withdrawal, provided they were delivered sealed or packaged:
- Adult toys (vibrators, dildos, masturbators, sleeves, anal products, etc.)
- BDSM, latex, and fetish products
- Lubricants, gels, and cosmetic products
- Any products that come into direct contact with intimate zones
- If the seal or original packaging has been broken, the right of withdrawal is irrevocably voided.
- Products that have been used, tested, or soiled will not be accepted and will not be taken back.
- Returns that do not meet these hygiene regulations will be refused; the right to a refund will be forfeited, and the product will be returned to the sender.
Article 9 – Warranty & Defects
- Statutory warranty applies. This means that a product must meet what the consumer can reasonably expect from it.
- Defects resulting from misuse, improper maintenance, modifications, or normal wear and tear are excluded from the warranty.
- The Consumer must report any visible defects or faults within 48 hours of receipt.
- In the event of a justified warranty claim, the Webshop will, at its discretion:
- Repair the product
- Replace the product
- Credit the purchase price
Article 10 – Liability
- The Webshop is not liable for damage caused by the misuse or incorrect application of the products.
- The Webshop is not liable for indirect damages, including consequential damages, lost profits, loss of data, or intangible damages.
- In all cases, the liability is limited to the maximum amount of the specific order.
Article 11 – Complaints Procedure
- Complaints can be submitted via email to: info@passionenpleasure.com
- The Webshop aims to respond to complaints within 5 business days.
- If a complaint cannot be resolved through mutual consultation, the Consumer can turn to independent mediation bodies in accordance with consumer rights legislation.
Article 12 – Disputes & Applicable Law
- Agreements between the Webshop and the Consumer are governed exclusively by Dutch law.
- For European consumers, additional mandatory consumer rights under European consumer law apply.
- Disputes will preferably be resolved through mutual consultation. If this proves impossible, the court of the Utrecht district has jurisdiction, unless the law dictates otherwise.
Article 13 – Privacy & Cookies (Reference)
- The Webshop processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR/AVG).
- For detailed information regarding data processing, please refer to the Privacy Policy and Cookie Policy available on the website.
Article 14 – Final Provisions
- If any provision of these terms and conditions is declared invalid or void, the remaining provisions shall remain fully in force.
- The Webshop reserves the right to amend these terms and conditions. Amendments will not apply to agreements that have already been concluded.
