Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. Webshop: Passion & Pleasure, trading as a sole proprietorship.
  2. Website: the webshop accessible via our domains and subdomains.
  3. Consumer: a natural person who is not acting in the exercise of a profession or business and who enters into an agreement with the webshop.
  4. Product: all goods offered via the webshop, including but not limited to erotic toys, lingerie, accessories and related products.
  5. Order: any distance contract between the consumer and the webshop.
  6. Right of withdrawal: mandatory option for consumers to cancel the agreement within the cooling-off period.
  7. Cooling-off period: period of 14 days after receipt of the product, unless excluded.
  8. Return: return of products in accordance with these terms and conditions.
  9. Discretion: delivery, packaging method and invoicing without traceable product information.

Article 2 – Applicability

  1. These general terms and conditions apply to every offer made by the webshop, to all orders and to all distance contracts concluded between Passion & Pleasure and the consumer.
  2. It is a condition that the consumer can take note of these terms and conditions prior to concluding the agreement.
  3. If specific product conditions apply (for example, regarding hygiene), these take precedence over general provisions, as far as possible.
  4. Deviations are only valid if agreed upon in writing.

Article 3 – Offer & display

  1. The offer contains a complete and accurate description of the products offered, including price indication and VAT.
  2. Obvious mistakes or errors do not bind the webshop.
  3. Images are for illustration purposes only; color and shape differences are possible.
  4. All offers are without obligation until the order has been confirmed.

Article 4 – Conclusion of the agreement

  1. The agreement is concluded at the moment of payment by the consumer, unless otherwise agreed.
  2. After placing an order, the consumer will receive a confirmation by email.
  3. If the webshop refuses an order (e.g. due to stock or safety reasons), the consumer will be informed in due time and the amount paid will be refunded if applicable.

Article 5 – Prices & Payment

  1. All prices stated on the website are in euros and include VAT, unless otherwise stated.
  2. During the period in which the offer is valid, prices will not be adjusted, except as a result of legal changes or errors.
  3. The consumer can pay via the payment methods offered during the ordering process, including electronic payments.
  4. The agreement is considered concluded once payment has been made, unless otherwise agreed.

Article 6 – Delivery, shipping and discretion

  1. Orders are shipped to the address provided by the consumer.
  2. The webshop delivers in the Netherlands and Europe, unless otherwise indicated.
  3. Products are discreetly packaged and shipped without any traceable product indication on the outside of the packaging.
  4. The webshop uses a discreet payment and billing designation in accordance with the nature of the product.
  5. The delivery time is usually 1–3 working days within the Netherlands and 2–5 working days to Belgium, unless otherwise stated.
  6. Exceeding the delivery period does not entitle the consumer to compensation, unless the delay causes the consumer to reasonably be entitled to dissolve the agreement.
  7. The risk of damage or loss of products passes to the consumer at the moment of delivery.

Article 7 – Right of withdrawal (Cooling-off period)

  1. The consumer has the right to dissolve the agreement without giving reasons within 14 days after receipt of the product.
  2. If the consumer wishes to exercise the right of withdrawal, he must do so within the cooling-off period via email or return form.
  3. After notification, the consumer has a maximum of 14 days to return the product.
  4. The consumer is responsible for the return costs, unless otherwise confirmed in writing.
  5. Upon correct receipt of the return, the webshop will refund the purchase amount within 14 days of receipt of the return.

Article 8 – Exceptions: Hygiene and Sealing

For hygienic reasons, the following products are always excluded from the right of withdrawal , provided they are delivered sealed or packaged:

  • Erotic toys
  • Vibrators and dildos
  • Masturbators and sleeves
  • Anal products
  • BDSM, latex and fetish products
  • Lubricants, gels and cosmetic products
  • Products that come into direct contact with intimate zones

If the seal of the original packaging is broken, the right of withdrawal irrevocably expires .

Products that have been used, tested or soiled will not be accepted and will not be taken back.

Returns that do not comply with the hygiene regulations will be refused; the right to a refund expires and the product will be returned to the sender.


Article 9 – Warranty & Defects

Legal warranty applies. This means that a product must meet the maximum expectations of the consumer.

  1. Defects resulting from improper use, incorrect maintenance, modifications or wear and tear are not covered by the warranty.
  2. The consumer must report defects within 48 hours of receipt.
  3. In the event of a justified warranty claim, the webshop will, at its discretion:
  • repair the product
  • replace the product
  • credit the purchase price

Article 10 – Liability

  1. The webshop is not liable for damage caused by improper use of products.
  2. The webshop is not liable for indirect damage, including consequential damage, loss of profit, loss of data or intangible damage.
  3. In all cases, liability is limited to the amount of the order.

Article 11 – Complaints Procedure

  1. Complaints can be submitted by e-mail via: info@passionenpleasure.com
  2. The webshop will respond to successful complaints within 5 working days.
  3. If a complaint cannot be resolved through mutual consultation, the consumer can turn to the independent complaints body in accordance with consumer law.

Article 12 – Disputes & Applicable Law

  1. Dutch law applies to agreements between the webshop and the consumer.
  2. For European consumers, additional rights apply in accordance with European consumer law.
  3. Disputes will preferably be resolved through consultation. If this proves impossible, the District Court of Utrecht has jurisdiction, unless the law stipulates otherwise.

Article 13 – Privacy & Cookies (Reference)

  1. The webshop processes personal data in accordance with current privacy legislation (GDPR).
  2. For information about data processing, please refer to the Privacy Policy and Cookie Policy on the webshop's website.

Article 14 – Final Provisions

  1. If a provision in these terms and conditions is declared invalid, the remaining provisions will remain in full force and effect.
  2. The webshop reserves the right to amend these terms and conditions. Amendments do not apply to concluded agreements.
